If you do not have a valid H-1B visa (that is, one that has not expired) stamped in your Indian passport when you leave the US, then you require a transit visa (DATV) to connect through Heathrow.
Even if you plan to get your H-1B stamped in India on this trip, a transit visa is still required when you are leaving from the US since the exemption is for those who have a valid, non-expired H-1B visa in the passport.
Even if you have an AP, a transit visa is still required since AP is not in the list of exemptions.
Note that only diplomatic and official passports from India are exempt. These are different from the ones we typically have.
I am in an identical situation flying out tomorrow afternoon.

Mine is similar case. I 140 approved from NSC. 485 filed in NSC on July 27 2007. Transferred to CSC. Received EAD and AP from CSC in October 2007. 485 transferred back to NSC October 2007. LUD in 485 in January 2008.

I am thinking of waiting till the end of this week and ask my Attorney what is his suggestions on 2nd time filing of I-485.
Does any one know if the I-485 applications mailed to USCIS thru USPS and reached on July 2nd has been rejected.
I would like to if anyone whose I-485 app reached USCIS on July2nd is planning to send for the second time.
I filed on July 2 W/O employment letter. So I asked my lawyer about file a 2nd application since now we have the letter on hand. His respondes on filing another application is negative. He said it will yeild confusion. Hope it helps.

It's not just Vegas. I got married in Norfolk, VA. Virginia does not require marriage license. Check the regulations in your state. But if your astrologer tells you to get married at 3:00AM, you need to go to Vegas :-)
The changes to your I485 form are minimal. There would be additional forms for your wife, but lawyers will usually charge extra for spouse anyway. So don't let your lawyer bullshit you.

I am planning to go for visa stamping in my next vacation during the christmas holidays. For booking appointments, do we need to go through the route of getting chalans from HDFC, getting appointment from VFS etc , or is there any other shortcut route for this?

I was in same boat. Desi company was not giving me ref letter and I asked my EX - colleague who was not with desi company any more and he gave me noterised letter on his current company and it worked. I had same job duties but desi company denied to give detail letter . They gave me simple letter with title and duration.

I am travelling on the same boat. Here is my case...
My prioprity date is Jan 2004 under EB-3 and still the labour is pending from New york(Philadelphia Backlog Center), its in DATA REVIEW. I have done my Bachelor of Science with Maths( 3 years) with GNIIT(2 years). In mean time my employer had a Pre approved labour with priority date Nov, 2001 and they filed the I140 in premium and it got denied straight away. The 15 and 14 column in the Pre approved labour says Bachelors in Maths, Comp Science, Engineering or equivalent. The education evalution says the same as "equivalent of an individual with a Bachelor of Science Degree in Comuputer Science from an accrediate college or university in the united states". So what does the equivalent means when the immigration defines it ?
My orginal filed labour is still in process but i does have the same problem and my lawyers fears that even if we file the I140 even that would be denied using the same case above. I am in the 7th year extension and my H1 is going to expire in 4 months, what are my options?

I had got an RFE for education. My employer applied labor under EB2. I did my B.E back in India and had 7 years of experience. My lawyer sent new evaluation report and I140 was approved in month.

As long as you have a valid H1 visa stamp in your passport from your previous company, you have to go out of the country like canada (Requires a tourist or business visa), mexico, india or bahamas (some guy went on a cruise and came back) to get a new I-94

I've heard I might not be able to go to Canada or Mexico and have to go to my homecountry? My attorney on the other hand says all I need to do is leave&reentry without even going through a consulate, just to get a new I-94.
Just want to double check that I'm not making any mistakes by going to Mexico instead of my home country (Italy).

But look what happened..........everyone has an EAD but hardly one or two changed their jobs. typical indian behavior, expected outcome.

It is my question and it was simple, how is the job market in recession (as many of us were planning to use AC21)
If you have any positive inputs, please provide else you were adviced to leave.

You are already benefited by AOS 485. How can you shift now. I know, there is a Form 8xxx. something, which would cancel 485, and provide CP. But knowing the level of efficiency and proximity, it is NO BRAINER to adapt that route.
Also, if Ron's Pessimism should hold good, NO ONE in the immgn. community is good to go. Dont worry tooo much, Look at the pace, you got July 07, Fiasco results. I donot think, the error cases are even 1% of total filing. Though, they initially messed around, people were benefited with that.
Again see the flow of EAD Renewals... Good and encouraging. Dont swing around, and stay tuned.. You are fine to go.. Trust me.. Have confidence in the system, it will deliver. :) Your good friend's advice.
