Hi, my husband and I had our interview today at 2pm located in San Jose. Everybody was called for their interview except us and we were wondering why we had to wait for an hour and 25 minutes. Only then we found out, the immigration officer who picked up our appointment letter forgot about us. :mad: When we finally got in touch with someone, we got called in at 3:25 by an old lady immigration officer. She was cold, unfriendly, had a very serious face, and did not make eye contact at all. She did not make things easy for us and there was tension everywhere.
My husband and I have been together for almost 7 years now, but we've only been married for 5 months. I am the petitioner and my husband is the beneficiary. We don't live together because of school and work complications. But we do have evidence to show our marriage is bona fide. Starting with airline itineraries visiting each other going back from 2004 to present, joint checkings/savings account, joint auto insurance, joint credit cards, joint phone account, email love letters and online chat messages from 2003 to present, receipts from motels where we stayed whenever we visited each other, and receipts from places where we ate together. Also, we turned in my tax returns, 2005, 2006, and 2007 and since I have already filed for my 2008, I have included that as part of the supporting documents. We also turned in my pay stubs for the month of February and March, along with an employment verification letter from my employer. Even though we have turned all of these documents to support our marriage is real, the immigration officer gave us the face as if we're going to get denied anyway. Then as she was going through the supporting documents we submitted with the application I-485, she noticed the seal on my husband's court disposition letter was missing. They lost the seal and told us we have to go back to court and get another one because she was thinking we tampered with it. Oh my god, in my mind, I wanted to lecture her to tell their clerks to be careful when filing important documents. They lost the seal to the court disposition letter! :mad: Then she saw her colleague and asked for his opinion and said to him, 'we have a problem'. He started asking us questions like how we met, how old we were, why we're not living together. After we answered, he said 'thats a tough one' and then he left the room. Then, our immigration officer stood up and said she's late for her doctor's appointment. My husband and I were so confused and shocked by all this. It was as if she didn't give a crap about us just because we don't live together even though we have tons of evidence to back up our marriage. It was the worst feeling in the world and felt like our life was taken out of us. :(
So now, we were given a piece of paper stating we have to turn in another one of my husband's court disposition letter with the seal included. It was their fault in the first place for losing it. By referencing the H-1B Program, I believe the writer has inadvertently diluted IV's goals. The home page clearly states IV's objective as ".... working to alleviate the problems faced by legal high-skilled foreign workers in the United States....".

Might be difficult to show it as a "permanent job".
Check the options of being self-employed (or start your own company) with a contract commitment from them. Basically you claim "a permanent self-employment or permanent job at your own company" and legitimacy of it is claimed by "long term contract commitment documents" from state.

I am one of the late new comers who came to know about the IV and will certainly try to come to the rally and have spent countless going thru the forum from anonymous member?
What strikes me me that the the highly Skilled immigrant community has not differentiated them from the rest of the population very well.As any first marketing MBA can tell you the your Unique Selling Point is the differentiating factor.
Highly skilled immigrants sound good for USCIS and legal terminalogy but for general public must know that you are the doctors who take care of them and their children, Computer Engineers who keep the system up and running , the pharmacist , the medical researchers
My point is show your educational achivements for the public to understand that you are highly skilled if you have Bachelors Degree ,Masters degree , PhD , Pharma , MD then show it.You earned then it fact flaunt it :D

No you can file for h1b extension only 6 months before expiry.
So get all your paper work ready and wait for 6 months time and then file early. By the way why do you want to apply 1 year in advance ? any particular reason ?

Hopefully u'll get the GC, if not another 3 years and another for the rest of ur life if you can stick to the same position :) If a PERM is filed in the 6th year of the H-1 (after the 5 year anniversary), is approved, and an I-140 is filed and approved (through premium processing), the foreigner can get a 3-year extension on H-1.

I am also in the same boat. My attorney sent application on July 18th and reached NSC on July 19th. No clue on the application status yet. Do you know who received your application? Mine was received by BESCH.

Not a clue ... whats going on so far!!
But looks like many of us will have some ray of hope before this weekend.
As there are many JUly2nd filers and they have no yet received receipts, but they would complete the 90 days looong wait as of oct 2nd and USCIS need to reply to their unending calls !!! AND USCIS is aware of it..!
So, hopefully they will clear a major chunk of it so that they are sure no july 2nd filers are left.. !
Hope this comes out true..for all!

I have 10 months in H1 now. My perm got denied because
the certifying officer thought my inhouse experience is similar
to job requirement. I have accumulated 5 years experience from the
same company (50%) rule. I have to re-advertise to file new perm
since recruitment is 180 days old.
H1 is till June. Lawyer wants to start fresh perm. I do not have time.
if premium processing does not start I will be screwed one more time
again.

EB2 is current for ROW. can I stay in work permit in the country..

No you do not need to send photos after efiling, because you have physically go to USCIS center and get photographed and finger printed. My PD is sept 03 and already received my GC last year, but my wife's is still pending (initialy it was name check and now for no reason). Anyways, we received her EAD today... it took a long time though... she applied in May and received it yesterday... exactly after 95 days...

I heard company also has to book a ticket if they cancel your H1B. I do not think company will take that much risk. Also before they file suit against you, they might have 100 fraud things they are afraid of. Try to find some of their weak points(not paying bench, taking amount for H1B, etc) and tell them you will file counter law suit and you will show these weak points as reason leaving.

Starting a new thread so members can make use of our experience at SAN JOSE.
Post all congratulatory notes in the other thread.
Only suggestions here please:
1) Any placards must have the word LEGAL in big black bold letters. Its very easy to read legal as il-legal when you are driving by in a car....
2) I think its a good idea to pre plan the route so you can choose big side walks... ideally 2 miles round trip is very easy to do-- also print the route map and directions and distribute so organizers wont have to stay in front at all times
3) choose spots where the sidewalk is really big so you can assemble.. at different rendezvous points.
4) ensure that at no point pedestrians are skipping signals..
after we obey every rule there is....
befriend the police... smile at everyone....
other partcipants please add... to this thread...

Just wanted to post a suggestion. (one that you already made Rangaswamy).
We need to send a thank you note to the local police, for support in terms of logistics or helping in maintaining the law and order or just a thank you note for being so helpful. This can be a letter to the poilice department on any other means. I feel we should appreciate their efforts although they were doing only their jobs, But it was a job well done.

To be honest this a very vague area of the law. I have seen people switch to unrelated job getting GC's without any issues and also know of one who did everything by the book getting an RFE. Just talk to your lawyer and stick to what he says, we end up over analyzing issues and miss the bus. I say this because i have done everything by the book so far and am still waiting. I hear that they are getting more particular about AC21 these days. Do what you think is best for you and once you take a decision just go ahead.

Thanks. Basically I am looking for consulting firms (does not matter if they are Desi or non-Desi) that will sponsor H1B. Currently I am in H4.
If you are trying to get into the h1b stream - you will be subject to cap, if you have a US Master's your chances are better otherwise if you want your petition to be considered for the lucky draw after the blackout, your petition has to reach early morning on April 1st.

I am completing 6 years in USA by Oct 2010(Current H1 expires). My employer applied for labor in Oct 2007. But it got declined in Dec 10, 2009. My employer is going to file new labor in March, 2010. According to the current labor approvals, Can my labor and 140 gets approved and file for H1B extension before current one expires? If not, what are my option to either extend current H1B or continue to stay and work?
Let me know if you need more information. I am new to this forum.

I believe all USCIS want to check here is, whether you engaged in "un-authorized" employment after your last admittance to US. From your explanation, I believe you dont have to worry too much, just provide the facts. And give your correct employment letter, and copies of "authorization to work" during the period.
If USCIS want specifically to address a discrepancy in G325, the most common procedure is to ask a new g325.
Also the "permanent" wording in the RFE makes me even think that the whole RFE might be a mistake. A lot of new & less experienced officers in USCIS now a days.
