My friend has the exact same mistake, but this time with her green card. They mistakenly put "male" with her picture on it. She never had it changed and she has used it to travel without any problems. Good luck.

This is POE in Dallas. In Nov'08 on my return flight, I was sitting next to a consultant who went back to India for 2 months after the project was done. We started talking about immigration etc on the plane and she had casually mentioned that she is praying she gets a project because of the October tanking of economy while she was out. She was at a different window and then she started walking behind the IO crying and ran into me. All she said was "client letter"-no time for a conversation. I do not know whatever happened to her, didn't see her come out while I waited for bags and went through customs.
TARP POE problems sound like rumors to me. But they are cracking down on benched consultants.
I have always carried client letter (when I was consulting) along with their contact info, co workers contacts info - appraised my client management of this issue where IO can give trouble at POE and to be ready to asnwer a phone call or probably fax information when I return back.
Now I am in fulltime job on EAD but I still did the same, appraised my HR dept about possible trouble these people can give and got a letter and also asked her to be available to answer any queries if called.
I never had any issues at POE till now - I travelled to India around 10 times now, there was only one incident at POE in Atlanta in 2004 where the IO kept saying he is not able to look me up in his computer and kept asking whether it is really a visa and sent me for secondary inspection where they asked me about my company (if it is a Indian consulting company and I said it is a US product company, then the officer explained that the reason why I was not on their computer is because Chennai consulate sometimes uploads batches late and there are delays which is not the case always - she called USCIS or some other place shared my i 797 number talked for a min and then just let me in.
Folks MUST expect to be asked questions. Keep all your w2, paystubs, client letters and all information. Do not take immigration lightly.

My lawyer asked me to mail again with a cover letter saying that since my checks were not cashed even after 60 days I am mailing again. I asked the clerk to ignore the new application if they see my original application by the time they open this.
This means you have to get another medical report, photos, etc. Is your lawyer charging you for second filing?

I would recommend that if you can get a new BC with corrected names and submit an affidavit saying that all these Kumar / Bhai are just cultural notations and not actual names it will work. Just to support this argument you can present some older documentations like school leaving etc that have consistent names written all the way upto your passport. So that way we can present to USCIS that these are not part of your names. Also any proffessional translation agency if willing to say the same will be better but I feel that if you have some additonal documentation that has names written which are consistent with what you have on passport that will make your case stronger since then we can easily say that names on BC are just an one off thing due to cultural sensitivities 30 years ago and you never had these bhai / kumar associated with you

One clarifying quesiton. If my parents get an updated Birth Certificate from Indian Authority stating the name that is consistent with all other documents, would that suffice the need for RFE ?
Issue date for that Birth Certificate would be current date.

Its risky to quit your job the day after you get a GC. USCIS can revoke the GC saying you never intended to be remain employed at your LC advertised position. The burden is then on you to prove otherwise.Most attorneys advise staying put for a minimum of six months to be on the safe side.

Hi ,
My wife and I are currently on H1 visas working for different companies. She is supposed to travel to India this sunday(Jun 17th) for a 7 week trip where she had a consulate appointment for stamping etc and is scheduled to return on Aug 5th 2007.
We are in a dilemma from yesterday when we came to know that I485 has become current. We are looking at two options but am not getting any lawyers to confirm as they are all at the immigration conference till Monday and I need an immediate solution. The two options are
1) She cancels her trip and we file and wait for the EAD etc before both of us go. However it is 80% essential she goes now.
2) She goes on Sunday, and I get all my 485 docs/health certificates in order and file and file in July. When she comes back in Aug I can add her on to my 485. Is this feasible and will this affect my 485 application?
3) SHe travels a week later and we can complete all documentation within a week? Is this feasible?
Any and all responses are appreciated and any other option we can consider.
One attorney got back to me saying if she adds on to my 485 in aug, there might be problems if it is not current and your application may also be pulled out of the quese. Is this right.
Long post, But I am in a big dilemma here and the trip is very important to my wife but the GC is on top of our priorities as well. Looking forward to getting a solution from the learned members in this group.

There are strong indications (but nothing fully confirmed) that Sen. Grassley will be taking the ranking member slot at Judiciary, and of course relinquish his ranking member position at Finance.

It looks like they are doing all sorts law breaking just to make sure the July bulletin does not look like a mini amnesty.
This is the truth.
Now, how many laws they broke or are breaking? Every step they take will be unethical because this does not really have to do anything with the agencies, it is coming from the politicians.
I have written about this before - the agencies are prepared to take the shot and trying to make themselves immune to law suits.
Protests will give media attention and lawsuits may do some good, but chances are that these agencies and politicians will do some fire extuinguishing now, but does not mean that they will not flip flop their laws.
The fact that they allow tons of people to cross all porous borders itself shows how much they follow law.
The fact that they wasted visa numbers in past.
In general these agencies make it look as if they are inefficient and slow and no proper coordination, but in reality they are capable of adjujicating 60K visas in 3 weeks.
This issue is not only for us, but highly prevailant in govt organizations. Look at how passport applications are backlogged.

Just curious what you were doing in last 15 years.
You filed GC in 2006. So what did you do in the 12 years before that :). Just gathering points and would like to add your case too. You seem to have also joined us much later in 2008.:confused:

If you are afraid of withholding of pay then leave quietly from the company saying going to India etc excuse so that your payroll gets processed. I have seen people doing that effectively.
Legally they should not withhold pay and if they do, then you can complain to DOL.
DOL is awfully slow sometimes in getting the enforcement done.
I am simply asking my questions bcoz i am little nervous before taking this step. so taking little advice from other people.

Business HIRES you for your skills, but the country LETS YOU IN as a permanent resident not only for your skills! Mind you, your company doesn't grant you the right to stay here in this country. The government grants you the right. THE US also has to consider how many people it is letting in from your country. As I understand it, Congress (yes, they still make the laws, not the board of directors of your company, which I am sure must lobby, but doesnt't quite get to enact legislation in Congress) wants to keep a balance of immigration from a wide spectrum of countries.
Business may sponsor you for a green card, but it doesn't LET YOU In to the country. The nation has designated the USCIS to do that and the USCIS does based on the laws that Congress makes. What part of this ain't clear to ya?

Guys,
My wife is going to give her DL test this weekend in NJ. Although I had to give a written exam and pass a road test for my DL, I have been hearing stories that nowadays some centers give you the DL just after passing the written test - No Road Test needed. While am not against giving a road test, I think it will be pretty sweet to get the DL right after passing the written exam. She does have a valid Indian DL (in english) in case that helps.
Can you guys share your experience with DMV and tell me in your opinion which DMV office is better in this regard?

Ideally, you should have put your name in the DS-160 as the person paying for the trip. Now I would suggest; Prepare the I-134 in your name and the invitation in both your and your wife's name. If your wife fills the I-134 then you won't be able to show a salary which significantly weakens your case.
Don't worry too much about the relation being strong or weak. If you and your wife are inviting then there is no problem. The consulate understands that husband and wife are really one entity with a combined source of income and expenditure.

I have read in murthy forum, that one can use the EAD for one job and H1 another job. But other guys are saying if you use EAD, your H1 is gone. So please search in murthy.com. If you find any useful information, please share it here and others can benefit also.

Yes! Along with Murthy, I have heard this from other reputed attorneys as well. Also, one point to remember is that you do not inform the USCIS that you have used the EAD for your part time job. All you do is fill out the I9 for verifying employment eligibility.

you can file EB2 if the job requirement has alternative education/experience i.e. Bechelors + 5 year progressive experience.
The Same company can file your new labor application in EB2 provided the New Job description is atleast 50% or more different than your current job. you can then use the experience gained in the current company towards your EB2 qualification (new Job desc). example is - let say your current role is Software Engineer and the next job is Manager, your job description may be a lot different.
The above is my understanding and I am not an attorney :)
