Senator Casey, as you may know, immigration system is broken, even for legal immigrants. Our community represented by Immigration Voice, face a waiting period between 10-25 years before we get our green cards.
During this wait, we lose many opportunities and it inhibits our contribution to our companies, and the economy as some of the laws are old and archaic. When you are elected to serve PA again, will you support our provision of eliminating country caps on employment based green card system? You see, when an employer decides to hire us, the one question that is never asked to attain the job is �which country was I born in�, however, this is the very question that defines our community and the mess we are in today. Inaction only perpetuates the unfairness, and we would like to know your take on this matter.

In the 90,000 visas set aside for the people who have already applied in the old process, is there an exemption from the country cap? I don't remember seeing any such thing. These 90,000 visas would be mainly applicable to citizens of India, China and Mexico. If the country cap is applied, then only 9,000 visas will be set aside for each country. It is estimated that there are over 250,000 -300,000 EB GC applications from Indian citizens. At that rate it might take many decades to get our GC. In the mean while the wasted GCs from this category would fall over to the Y visa holders.
IV core should ask for exemption from the country cap for this category or at the very least ask for the roll over to be contained within this category.

I have a birth certificate issues by State Municipality in year 2003 stating the late registration was done on authority of a Magistrate. My wife has no BC.
My attorney said that my BC would work as is. As for my wife she just needs to get affidavits from Parents. Thats it.

where the 140 is approved in the same service center 485 has to be applied. before 2006 April a lot of people's 140 is fied in VT or CA their cases will be transferred to them.
if 140 is approved from TX then 485 will be transferred to TX

i have done an s-corp on ead and i am the shareholder, director, ceo, treasurer, secretary, sales man and producer... my primary day job is in IT and i intend to run this s-corp part time doing non-IT work... my lawyers tell me there is nothing wrong with this setup... but they said that if you work for yourself for the day job (i.e. GC sponsoring job), the burden of proving to USCIS that you really have plentiful work to keep you employed 40 hours a week and 2000 hours a year on a "permanent" basis (whatever be the number) lands on your shoulders... if things go south and you are unable to prove permanent employment to USCIS satisfaction, there is not too much you can do to save yourself... as for non-IT (or IT) part time work in your own corporation, i am basically free to do anything other than a sponsoring job as long as i can prove that i intend to work for my GC sponsor permanently. remember, all this shit happens only if USCIS sends an RFE and then they actually read through it and discover what you dont want them to discover and then they take objections...
so at the end of the day, in terms of law, i or my lawyers would not say it is illegal to do what you or i are doing... but such cases have not had a precedent in the courts that you or i could potentially use as a guideline for your decisions...
even i am in the middle of decision making as to whether I should dissolve and restart my illinois corporation with some other director and office than me...

Yes, my lawyer sent it to the exact same address (without the PO box) in June via FedEx and I got the receipt number.

Well they reject that....their explanation is "So you are going to the US to baby sit?". Not a good idea because I know of atleast 2 cases where the visa was rejected with this explanation.

For USCIS prospective, does it matter if I file myself 2008 federal and state tax return online using Turbo tax/ TaxAct. If there is any RFE in future on pending I-485 for tax filing, Will USCIS accept online filed 1040 form?

Wish I knew this was an option. My current EAD valid for 1 year expires on Oct 10th. I am maintaining my H1 status. Does anyone think I can trying calling customer service and go that route to see if they retrigger my ead application and issue me a year extension? By the way what number do you call to inquire about this?
Why did you wait for so long? They way that USCIS works...I dont know if they will re-open your original application and reconsider giving you a 2-yr EAD...but might be worth a try.
The USCIS Customer Service Number if the one on the back of the card (or on the stub that the EAD card was attached with). However, I don't think calling Customer Service will help as such...they will just tell you to send a new application..

Or might be their superiors are just waiting on a complaint to be filed so that they will have a reason to remove such a rude person from office.
U will come across rude IO, VO, DMV etc... officers more often in coming days. You may not 'individuallly' be able to counter them because their superiors may be sympathetic towards them.
Be very polite when they turn rude to you. Talk to them well, and politely ask for their name, and describe your incident to the complaints cell.
If this pattern is repeating and is happening to everyone, then collective action can be taken and will be effective.

Sorry for the confusion but I am not on H1B i am on my EAD already for over a year now. In that case, I guess I can be employee of my own company. Plus even if I quit as a CFO, the problem is if USCIS wants they can see it on the paper that I quit the role, so whats the point quitting. I may be wrong but just a thought.

will really appreciate some help with this... i have so far heard only instances of people coming back in with no problems with the same visa but a lot of information available online seems to indicate that visa is void and one cannot come back on the same visa.
