Okay lets take your example. A & B are graduates with a Bachelors degree (A is a Mechanical and B is Computer Science). A decides to pursue higher study in Mechanical field and B takes up a Software job. After a year they file for B' EB3 at his work, while A is still at school. A joins a software company (His Masters in Mechanical is worth nothing now). EB2 is filed for A just because he has a Masters, B is also eligible for EB2 by that time. Why can't B get a earlier PD? Atleast B got relevant industry experience. How come A is superior than B?
Also why should EB2's get the spillover visas from EB1? Do they have a Ph.D? Why can't they allocate spillover visas from EB1 equally between EB2 and EB3?
In that case A will be eligible only for a EB3 based on the Job requirement.( Since eligibility is based on the Job requirement and not the person's qualification)

Why are you consistently discussing about H-1B caps. Green card delays are not because of H-1B quota, I am sure you know this. H-1B caps have nothing to do who applied for the H-1s, whether those were consulting companies in US or a company in Japan. You are just saying it consistently in all your posts because you don�t like more people coming here after you are on path to green cards. In all your posts, you have this mid set where the door closes right behind you and more people should not be allowed on H-1. I am sure you qualify to be the member of IEEE-USA. Please Google search for their membership form. Just because the name of the organization is �Institute of Electrical and Electronics Engineers� doesn�t mean that every thing on their agenda is kosher.

My friend we live in a very strange world in which political organization (like IEEE) show stuff on their website just so that they don�t appear to be outright anti-immigrants.
Also, I do think that anybody who do not want to pick up their ass to find a job and rather chose to whine about someone else taking away the job is lazy and for sure undeserving. They are interested to put restrictions on H-1B because they want to eliminate their competition. Every community/group, big or small, have their opponents and enemies just because of the sheer nature of the competition for resource with other groups/communities. H-1B community now forms substantially large group of people. It is natural that orgs like IEEE-USA will be a natural opponent of H-1B community because there is a competition. Now, most members of IEEE-USA are older and middle aged folks, who are not able to compete with good quality engineers from other parts of the world. The folks on H-1 are young, dynamic and fast learners. IEEE-USA folks cannot compete with this group and so they are working to eliminate competition from H-1B folks by other means. Sometimes they call H-1Bs as indentured servants, sometimes promoting outsourcing, sometimes taking away their jobs and sometime depressing wages. They throw out all sorts of rationale to hurt H-1B community. And some idiots on this and other forums have not clue of the bigger picture and are hell bent on screwing the so called �body shoppers� as if it is ok to work at the client site to do the same job at the same amount if you are employees of KPMG or Accenture or Bearing Point. But it is not ok to do the same thing if you are an employee of TCS, INFY or SIFY etc. If this is not discrimination, then tell me what is????? Just like any other organization in the world, IEEE-USA is working to address the issues of their members only. IEEE-USA is working to fix the issues of their members who live in USA ONLY. It has no clue and no desire and no objective to look at any of your issues, no matter what they are. We all acknowledge that are problems with the H-1B program but the question is, Is Durbin-Grassley approach the real solution to the problem? Congress did not address anything associated with H-1B visa for last 6-7 years. If you write to lawmakers they only understand only thing about the word �H-1B� and that is increase in H-1B� that�s it. Now every system in the world needs tweaking from time to time and this has not happened with H-1B program for a very long time. Either way, throwing out people waiting for green cards for 6-7 years is not the solution, putting in restrictions to undermine the entire H-1B program (because they know they will not have enough votes to reduce the visa numbers or eliminate the program) is not the solution, �investigating� companies when they hire someone on H-1B as if hiring someone on H-1B is a crime is not the solution, singling out companies from one country because the guy driving IEEE-USA (Ron Hira) doesn�t want more people to come from India because he hates his heritage � is not the solution. In China, Crime Is Kept Quiet, Except on TV

Last June, hours after her students went home, Sunny Shi, the principal at a kindergarten in Shanghai's Pudong district, was bludgeoned to death in her office. The suspect was another school employee.
Officially, it was as if the murder never happened. Not a word was reported publicly by Shanghai police or local media. As talk circulated among parents, the school's administrators offered trauma counseling but requested their silence. "Now the case is under police investigation," the chief administrator said by email, and "we regret that we cannot provide any details."
The treatment of this case was not unusual. All across China, authorities are thought to hush up episodes like Ms. Shi's killing, which explains in large part why no one knows how much crime occurs in the world's most populous nation. But few doubt that crime is increasing as economic growth divides rich from poor and China permits more personal mobility.
"In the era of Mao, China was known as a virtually crime-free society," says Steven F. Messner, a University of Albany sociology professor who studies criminality. "To get rich is glorious" is the philosophy today, he added, "but there would be a darker side in terms of crime."
China's national crime statistics show a sharp escalation in cases over the past decade, led in particular by non-violent larceny, like bicycle theft and purse snatching. But, as in the U.S., the official numbers also point to steep declines in violent crime, with the murder rate dropping by half between 2000 and 2009.
Experts consider China's crime statistics both problematic and politicized. They also generally agree that the country remains safe by Western standards. Dark streets don't imply danger here.
Evidence abounds, however, that the Communist Party leadership's ideal of a "harmonious society" remains a target, not the reality. In China's growing cities, aluminum bars over windows and doors make most apartments resemble jails. Homeowners are snapping up security devices like cameras and alarms.
Anxious about kidnapping, China's newly wealthy often drive bullet-proof Land Rovers and hire kung fu masters from Shaolin Temple as security agents.
Television contributes a fear factor with real-crime shows modeled on "America's Most Wanted" and "Cops." China Central Television says its law-and-order channel grabs more viewers than its sports stations. Every day, CCTV's one-hour documentary "Legal Report" follows detectives as they crack sensational abduction, extortion and robbery cases.
Its coverage of a spate of apparently random attacks on seven women this year in Hebei province, for instance, featured the nighttime capture of 23-year-old Zhang Yunshuai. His foldable knife decorated with a butterfly was shown as evidence. He was led to a subsequent interview wearing a reflective orange prison vest and cuffed at the wrists and ankles, where he tilted his shaved head and muttered, "because women break my heart."
Shorter installments drew on security cameras that captured a thief shielding his pilfering hand beneath a menu in a crowded Beijing restaurant and thugs casing hotel lobbies for handbags.
On these true-life crime shows, "the man" consistently finds his perp. A popular notion holds that the censors permit these shows about China's criminal underworld because they allow the leadership to demonstrate how the pervasive surveillance of the government equates to swift justice.
Canadian Debra O'Brien got an up-close look at China's criminal justice system after her 22-year-old daughter Diana was stabbed to death three years ago in Shanghai, a bombshell case just weeks before the start of the 2008 Olympics. Authorities quickly won a confession from Chen Jun, a penniless 18-year-old migrant from rural Anhui province. Mr. Chen admitted he struggled with the aspiring model during his bungled attempt to burgle her apartment, located steps from a tea shop that recently fired him.
Ms. O'Brien left impressed. She received extensive briefings by senior police and personal copies of forensic photos. The judge even sought her opinion about a death sentence for Mr. Chen. She had a face-to-face with the apologetic killer.
"It was all shocking and horrific, but everything was done really respectfully and transparently," Ms. O'Brien said by telephone. "You don't feel there is a lot of ego going on. People are doing their jobs."
But the public wasn't offered many details. Ms. O'Brien herself admits she isn't sure of what happened to Mr. Chen but believes he became eligible for release two months ago. Mr. Chen's lawyer says he is serving life.
Pi Yijun, a professor of criminal justice at China University of Political Science and Law in Beijing, says that he sees crime rising and getting more violent, which he attributes to anger and frustration among society's have-nots. "The accepted mindset seems, 'fists are more powerful than reason,'" he said.
But in a rare 2004 survey of crime victimization, centered on the northern city Tianjin, the University of Albany's Mr. Messner found that few people were touched personally by crimes worse than a stolen bicycle. He credits traditional features of Chinese society. "You still have a much more communitarian orientation than the extreme individualism you see in the U.S.," he said.

One thing everyone needs to realize is that 21st century wars are not cheap anymore.
India just decided to implement the 12th pay commission's recommendations to its defense forces. A surgical strike is politically a risky venture. A strike may cause immediate gains and soothe tempers of the indian public but the battle will be fought through the media reports. Also, neither does the country have a national identity system nor has India been so serious about reaching out in a pro-active way. A weak border and the continuing saga of the rich getting richer and the poor getting poorer, not to mention caste based politics, will augment future terrorist plans.
Pakistan has found a money maker in terrorism. US Aid to pakistan to fight terrorists will reach $8B after 9/11 ( http://www.americanprogress.org/issues/2008/08/pakistan_aid_numbers.html ) and more will be promised when the Iraq returns to stability and the focus turns to Pakistan's neighbor Afghanistan as the Taliban are gaining control again. This has been acknowledged by the new president-elect. Zardari's snub to curtail recession by the Chinese and the Saudis only solidifies Pakistan's need to find other sources/means of making money. Providing a conduit for drug trafficking for the Afghani market is already a major revenue source. Corruption is rampant.
I believe that the rhetoric in the media about war mongering and troop pullouts from the afghan border are for think tanks in Congress and the Pentagon to act and work to defuse the so called drama of war and renew their promises of providing aid in the form of $ and arms.
India has and will continue to be a peaceful and a reactive neighbor. It will continue significant investments in capital and policy to strengthen its internal security foundation and work towards economic prosperity by defending its borders rather than be a pro-active regional cop.
What India has gained, out of this sad and unfortunate event and its subsequent actions, is its status as a responsible upcoming super power in the region with diplomacy as the arrow and its nuclear capability as its bow!

It is preposterous to compare Mumbai attacks with a speculative India involvement in Baluchistan.
The principal actors, i.e. the actual fighters on the ground in Baluchitan are all Baluchis. Were Qasaab and his other 9 companions Kashmiris? What locus standi these west punjabi fighters have to attack Mumbai?
Baluch conflict is limited primarily to armed skirmishes between Pakitani army and BLA (and may be some other Baluch nationalist groups). In military terms it can legitimately be called fair fight because both parties are armed. The principal actors, i.e. the actual fighters on the ground in Baluchitan are all Baluchis. Were Qasaab and his other 9 companions Kashmiris? What locus standi these west punjabi fighters have to attack Mumbai?
Baluch conflict is limited primarily to armed skirmishes between Pakitani army and BLA (and may be some other Baluch nationalist groups). I emailed Sen Hutchinson from Texas to vote NO for the DREAM Act and I called it "Organized and Controlled" amnesty as illegal kids who will get GCs will be able to sponsor their illegal parents for GC after 4 years.
All the illegals who have kids in college will get get GC's in 4 yrs after their kids pass college while EB3 has to wait for 20 years. This is a joke. Look at the reply from the Sen below:

It caused a surge of labor filings for people who were here illegally. It allowed people who were beneficiaries of i-130's to also jump over to labor cert cases afterwards when they say nothing was happening with family petitions.
it really caused a drain to department of labor at the state level in the heavily populated states. This is when all the drama began (companies setting up show in delaware, maine, new hampshire, south dakota).
Just with how the laws work; different agencies; different fuding, different jurisdictions; it is difficult for the agenices to do process improvement because congress doesn't ask them if they can handle a law change. Law gets changed and the agencies don't have enough time to implement or get ready for it; and then we all crib about it.
I know everyone is in a bit of a high right now that they can file 485's but without increasing quota or allowing more people to get approved; we will definitely see some anxiety from many people.
Honestly; my biggest worry is the people who work at consulting companies and want to leave the first chance they get. Every time a company files a 140, h-1b; it gives a chance for uscis to go through the whole immigration history of a company. At certain points the number of 140's will be greater then the actual number of people working at the company. If they start detecting a pattern that everyone is leaving;it will look like company is set up for immigration purpose.
California service center was just getting tough with this before they stopped doing 140's. You have rekindled my interest. I am not a lawyer but have been in a job that required reading contracts and legal matters. Your points made me think that we may have some case here. So if you are intersted we could take some legal opinion. If four or five people can join then we can share the cost for the initial consultation.

As I was pointing out earlier, this debate has become warperd. The question is about porting with BS+5, not porting per se. I believe the BS+5 came from a legacy INS memo after a lawsuit or something. Perhaps we should ask the question on one of the attorney forums.

Why then should Obama support anti-EB measures that will hurt his chances in the future, when he'll get no benefits by supporting those measures?

My employer back in 2001 and 2002 did not pay me in a consistent way..I was paid once in every three months during the time I was in bench. I have the W2 returns from those two years which shows average income of only 29K. However I had valid visa status and h1b approval from my employer as well as employment verification letter from them. Now i am with a new employer since 2003 and do not have any problems with them and get paid regularly. After reading manub's post I am also worried if my I485 will be denied whenever I apply for it... or is there somethings I can take care of before? It is not my fault that the employer did not pay me consistently - right?
There are some serious issues here.
You got 29k salary for 2 years and still maintain that you had valid status for these 2 years.
I suggest you consult a good attorney.

A JOB is what decides EB1/2/3, not your imagined eligibility !!
If the job that you do requires no more than an EB3, then how are you saying your employer did something wrong? Why should you get to port to EB2 based on your "imagined eligibility for EB2"? Please explain that to me.
Remember, the JOB REQUIREMENTS should be there, it does not matter if you are a PhD from MIT...........

There are two things you can do wait for the system to change to the way you want or else change yourself the way system wants. I am not saying what is right or wrong here it is just what I would have done.

Ever wondered why a lawsuit never got filed against Labor Substitution, or stealing of EB Gcs by nurses, or against the discriminatory country quotas?
Simple, you need an Immigration Attorney to file the case. The same AILA cardholding person who is expecting a windfall profit out of interfiling/PD porting. I am interested to see the immigration attorney who is willing to sacrifice profit for principle. It would be a first in history if that happen!!
Good luck to everyone willing to participate in this wild goose chase. I guess you guys have too much money in bank to spend over such a mission impossible. If only you'd contribute equally to IV campaigns...

Lou Dobbs at CNN is doing a quick vote to justify his oppinions against amnesty. So far, the majority of the vote is "against" rather than "for". I myself am not a big fan of the proposal becauses it deminishes efforts put in by legal immigrats like ourselves but regardless consider it necessary for us to support as it currently is the only bill alive including retrogression relief along with amnesty.
Media generates publicity by twisting a small fraction of reality. Imagine what Lou would say if he gets a unanimous vote against amnesty. I am sure he will make the best of it to promote negativism towards any relief efforts regardless of it being amnesty or retrogression relief. Please go to the URL below and cast your support vote!
