I am leagal stay this country for 10 yrs with due filling of taxes.
Now because of my GC employer i got screwed up big time.
140 DENIED on ability to pay.Didn't appeal or no MTR.
If i start my GC process all over again, it is 10 more years to see it.What to do NOW?
My EAD is valid through 2010.
If I were you I would pay for consultation with a good attorney like Ruben and explore all my options. Don't rely on free advise on this forums. You will get a better response with paid consultation. Lawyers generally charge somewhere between $100-200 for 15-30 minutes in person or phone consultation.
Explore if you can change into other visa category. F-1 might be a option if you can get I-20 quickly for Fall (August) semester. But I am not sure if I-140 applied would constitute a immigration intent. For F-1 COS you will need to show a non-immigration intent. If F-1 conversion is successful it will give you breathing room and you can think about the next step.

The answer is simple: Americans overwhelmingly oppose illegal immigration and support legal immigration. Throughout our history, immigrants have contributed to making this country more vibrant and economically dynamic. Once it is clear that in 20 years our nation will not again confront the specter of another 11 million people coming here illegally, Americans will embrace more welcoming immigration policies.Our plan has four pillars: requiring biometric Social Security cards to ensure that illegal workers cannot get jobs; fulfilling and strengthening our commitments on border security and interior enforcement; creating a process for admitting temporary workers; and implementing a tough but fair path to legalization for those already here.
Besides border security, ending illegal immigration will also require an effective employment verification system that holds employers accountable for hiring illegal workers. A tamper-proof ID system would dramatically decrease illegal immigration, experts have said, and would reduce the government revenue lost when employers and workers here illegally fail to pay taxes.
We would require all U.S. citizens and legal immigrants who want jobs to obtain a high-tech, fraud-proof Social Security card. Each card's unique biometric identifier would be stored only on the card; no government database would house everyone's information. The cards would not contain any private information, medical information or tracking devices. The card would be a high-tech version of the Social Security card that citizens already have.
Prospective employers would be responsible for swiping the cards through a machine to confirm a person's identity and immigration status. Employers who refused to swipe the card or who otherwise knowingly hired unauthorized workers would face stiff fines and, for repeat offenses, prison sentences.
We propose a zero-tolerance policy for gang members, smugglers, terrorists and those who commit other felonies after coming here illegally. We would bolster recent efforts to secure our borders by increasing the Border Patrol's staffing and funding for infrastructure and technology. More personnel would be deployed to the border immediately to fill gaps in apprehension capabilities.
Other steps include expanding domestic enforcement to better apprehend and deport those who commit crimes and completing an entry-exit system that tracks people who enter the United States on legal visas and reports those who overstay their visas to law enforcement databases.

I am July 02 filer, I would like to apply for AC21 to move to new employer. New employer has same job title and same job description.
My priority date : Jan 20,2006 EB3 India
I-140 approved in Sept 2006
I-485 filed on July 02 2007.
I think I can move to new employer from Jan 02 2008. Is this correct?

A related question - I am on 7th year of H1 expires Feb 08I have my EB2 Labor and I-140 approved. I-485 retrogressed. I have now got a better offer from other group in the company. However the lawyers and HR are risk averse and creating hurdles in the transfer stating that its not advisable since job description in original labor has changed.
Questions –
Once labor and I-140 are approved does job description really matter if you are not changing employers.
Can I get a 3 year extension on H1 even if more than 6 months remain before it expires, and apply for a new labor and 1-140 on a worst case basis.

I really have plans to go back after getting some good experience.
Anyway, nothing wrong in trying to get a gc and keeping the options open
BTW, job mkt in India is booming and people say the best time to go back is between now and coming three years.
Also, I am sure after few years my job would be outsourced to India.
I have seen so many IT jobs going to India thru big consultancy cos like Deloitte, Accenture etc etc

Just heard from some wonderful people in the HR that in their opinion, I cannot get payed till they have my H1B extension approval in hand! Of course, the same wonderful HR people waited till the VERY LAST DAY to file the extension! So I have to wait for 2-3 months to get paid, even though I reminded them 2-3 months back to get started on my renewal?
I am soooo done with this country and its semi-educated, inefficient and ignorant bureaucracy and its blood-sucking, greedy, exploitative employers.
The USPS won't forward my mail to my new address correctly after they send me the receipt for my change of address form!
The SSA loses my new-born son's social security card!
Something is going terribly wrong with this country.
I think we had a much better quality of service in India even 10 years back.

Post matches are very extremely difficult and chances in post matches are generally rare.
Try to get into any priliminary position, for the post match, at least have 4 to 5 people calling into the programs and have fax machines ready so that if someone answers positively, you can immediately send your credentials. You have to do all this on a war footing basis
Scores of 90 and 91 are common these days and it has become extremely difficult to get residencies on h1b or j1, while it is a cake walk for those having EAD or GC.
You must also pass step 3 to be considered for h1b, so your chances are only for j1 visa.
Lot of h4, f1, b1 people from all over the world try to get h1 and j1 for residencies, due to retrogression, these numbers have increased because the number of h4s converting EAD or GC has come down because of retrogression and this has made it extremely easy for those having EAd and GC whereas it has caused flooding of applicants seeking h1b or j1.
You must also have passed step 3 as a criteria to be considered for h1b. So your chances are only j1 this year.
A lot of h1b sponsering institutions look for exceptional candidates, but most of them fill their seats through recomendations because the bar they raise seeking exceptional candidates is so high that they finally compromise on candidates having high recomendation.
Most if the residencies are not straight forward, they break all rules ie even in programs where they go for matching, they call the candidate and tell him/her that they will match him/her number 1 or 2 or 10 etc... which is illegal, but they do it expecting the candidate also to match them high, so the matching system is also completely polluted.
Residency programs give a lot of merit to h1b seekers with UK clinical experience, they consider these people as direct fits.
As far as subject is concerned, internal medicine and pshychiatry and pediatrics are options for h1b seekers and I think surgery maybe a difficult option.
Lot of information is found on www.usmleforum.org and you must start contacting your network of friends, alumni etc.... and the journey begins .............
If you have a Green Card or a EAD, sit back and relax, you will get residency with ease.
Concentrate in the New York region, thats where recomendations work out best for h1b seekers

What is this section 14 and 15. Can you apply for a Programmer Analyst job/labor/140 and still be ok with the 3 year degree?
Yes, I know of a very close friend who used Sub labor and filed 140 and 485 simultaniously at NE and ge got a RFE on 140 for ability to pay. His employer answered that and he got his 140 cleared i 4 months, and 6 months back he got his GC approved.
And his is EB2.

For H4 stamping, H1B stamping for the primary is not required. Also for H4, you need to show the relationship with the primary and show primary (spouse) is still working.
If you did some thing wrong here (overstay, crime etc..), you need to worry about your stamping. Otherwise H4 stamping is not a problem. Only H1B stamping need great preparation.

My sister is in H1B and never went back (3 years here). My brother in law went 3 times back to India and two times he stamped H4 without any problems. They just asked funny questions like how you spend time in USA without working etc.......
So go to India ASAP. If you go Canada, you may get into trouble or suspicion about your intension.

Since we do not have citizenship, we can make ourselves matter to citizens. When we realize that average American citizens are the people whom we need to team up with, politicians will start listening to us. So far we have been teaming up with illegals.
It is often said (and it is very correct) that divided we fall. So we have to stand as a team to success. The question really is, whom would we team up with?
You are mistaken if you believe that the dems support amnesty and the reps support legal immigration. The fact is that they support themselves and will take on a policy that will get them re-elected.

My friend has the exact same mistake, but this time with her green card. They mistakenly put "male" with her picture on it. She never had it changed and she has used it to travel without any problems. Good luck.
