HI Guys,
I got an RFE for the photos even though I have E-Filed. I am not sure why they have requested for photos. I am done with Bio-metric appt and Have responded to the RFE with the photos today. Waiting for the response.

I too was laid off (EB2, due to USCIS "affirmative misconduct"PD became Aug 06 (previously Aug 04), I140 approved, I485 pending more than 24 mths, have EAD but havent used it, renewed H1 till 2011, laid-off, no severance --- thinking about applying for unemployment).
My field of employment is few and far between....but hey....I need to keep looking at this crisis as an opportunity...and take some time off to do things I haven't done for ages...My spouse too is working on EAD.
Such a feeling of solidarity, to know there are several of us in the same boat :)

Thanks Everyone for your responses. My company said they filed a new labor for me but they cannot process H1 extension until my labor is approved and we don't have much time as i will be finishing 6th year soon. Any ideas what can i do in this situation?
Waiting for 6 years to know this is very tragic. Run your situation by a lawyer (not your company lawyer). You may find some workable options. Good Luck.

I would appreciate if anybody can shed some light on this issue. There are applicants in 2003 and 2004 or even earlier from coutries like India and China who started their immigration process way before this retrogression happened. They were and still some of them are hoping that their GC would come soon. From late 2005 the retrogression started.
Can these applicants write to the USCIS that they should not subjected to this retrogression since they were not notified of this retrogression before they started the process. In that way the USCIS can clear atleast their backlogs and the priority dates can move forward for the rest of the applicants. There may be a large group of such people in IV forum who all can come together and start this process.
I am not trying to discredit the applicants later in the process, but with the earlier applicants getting their GC. it will move the priority dates forward.
No one can be told about retrogression before they start (which is why it is retrogression). Of course you can write, but USCIS is not going to follow it unless it really plans to clean up its act. And if it does plan to clean up its act, your mails are not really required :)
There are lot of inefficiencies in the process. Look at what happened to people who went through BEC (worst affected, 4-5 years wait), then look at those who had to wait 2-4 years for the labor (but managed to stay clear of BEC). And then look at those who "Complain" that their PERM did not go through within a couple of months. And then look at the people who have very late priority date and yet claim to be a "victim" of USCIS (it really cracks me up), and that they are stuck with the process (even though they are in the system for less than a couple of years or so).
All of these are personal stories, USCIS could be a little kind hearted and follow the suggestions you make -- but they are not required to be so.
Also on a side note, their new system is probably going to be helpful in determining the new visa bulletin, but without processing efficiencies, it will be of no use.

Thats true. The delay is going to be significant and can be longer based on specuation from Mathew Oh (imigration-law.com) because of the Bi-Specialization ie. NSC and TSC taking care of I140 for all regions and VSC and CSC taking care of H1B's.
Also, the dates that they post are accurate only thing is that they post the date before which all cases are certified and does not necessarily mean the cases filed after date cannot be approved. The date only gaurantees that there is no case pending with USCIS before that date.

My case was in Nebraska and was transferred to National Benefit Center on lee Missoury the only answer i got is, it was transferred to speed up your process but i know and i have read that missouri only is a hub to local field offices, my lawyers does not know the answer some say it will be transferred to local office for an interview, My God Miami is so full and bad treatment from officer, i do not even want to think about it. If anyone has any input i will appreciate that.

This is a country with statue of liberty .. which means work at will fire at will. The company has to pay till the last hour you worked for them. The law is straight you work you get paid else the labor court can screw them for doing any business in future. Moreover if you are saying its a 2 man show, then they would ever go to the court for all this. It cost a lot of money and law over here is always on the side of the employee not the employer. Simple reason to give is dun like working for them thats it. I breached the non compete 2 times, and that too companies were nasdaq listed , even they couldn't do anything and paid every penny and even reimbursed the paid vacation left as well. So stop worrying and get on, I believe any one coming here by cutting so much of competition in India would know all these things.

I did the same mistake with my advance parole. I went to the local field office and explained them the situation and the need. They have put in the request for a new parole with corrected name and I received it with in a week. I suggest you go to the field office and try to get the corrected one.

Is it ok to have a gap between H1B expiry date (say July 31, 2008) and start of EAD (Oct 1, 2008) when a person is in AOS?
I would think it would be okay since AOS is a status (not EAD) which you maintain. EAD just allows you to work for anyone (but not maintain status. For status you use AOS/485)

My PD is Jun 06 and I just received 2 year EAD. Thank you IV staff. I'm grateful.
